TERMS OF SERVICE

OVERVIEW

Welcome to Dangle First Hockey Co. These Terms of Service govern your access to and use of the Dangle First Hockey Co. website, online store, products, content, features, tools and related services (collectively, the "Services").

The terms "Dangle First Hockey Co.", "Dangle First", "we", "us" and "our" refer to Dangle First Hockey Co.

Our online store is powered by Shopify, which enables us to provide the Services to you.

By visiting, interacting with, purchasing from or otherwise using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree with these Terms, you should not use the Services.

SECTION 1 - ACCESS AND ACCOUNTS

By using the Services, you represent that you are at least the age of majority in your province, territory, state or jurisdiction of residence, or that you have provided consent for your minor dependants to use the Services where applicable.

You agree that information you provide to us, including contact, billing, payment and shipping information, will be accurate, current and complete.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to accurately display and describe our products, including colours, artwork, materials, sizing and appearance. Actual colours and appearance may vary depending on your device, display settings, garment manufacturing variations and the nature of apparel decoration and production.

Because many Dangle First products are produced or decorated to fulfill customer orders, minor variations in print placement, colour reproduction and appearance may occur. These normal production variations are not considered defects.

Product descriptions, availability, pricing and specifications may be changed without notice. We may discontinue products or limit quantities at our discretion.

SECTION 3 - ORDERS

Placing an order constitutes an offer to purchase products from Dangle First Hockey Co. We reserve the right to accept, decline, limit or cancel an order where reasonably necessary, including in cases involving suspected fraud, pricing or inventory errors, payment issues, product availability or other circumstances affecting our ability to fulfill the order.

Payment must be successfully authorized and processed before an order can be fulfilled.

Please review your order carefully before submitting it.

Orders may be cancelled before production begins. Because many Dangle First products are produced specifically to fulfill customer orders, cancellation cannot be guaranteed after production has started.

Regular Dangle First merchandise may be returned or exchanged in accordance with our Refund Policy. Custom, personalized, team and made-to-specification products may be subject to different return and cancellation conditions as described in our Refund Policy.

SECTION 4 - PRICES, TAXES AND PAYMENT

Unless otherwise stated, prices displayed on our Canadian store are in Canadian dollars (CAD).

Prices, discounts and promotions may change without notice. The price applicable to your order will be shown during checkout.

Applicable sales taxes, shipping charges and other charges will be calculated and displayed during checkout where applicable.

You agree to provide accurate and complete payment and billing information and represent that you are authorized to use the payment method provided.

SECTION 5 - SHIPPING, DELIVERY AND PICKUP

Orders requiring shipment are subject to our Shipping Policy.

Processing and delivery estimates are provided as estimates and are not guarantees. Delivery may be affected by carrier delays, weather, service interruptions, remote destinations and other circumstances outside our reasonable control.

Customers are responsible for providing accurate and complete shipping information.

Free local pickup may be offered at designated Dangle First pickup locations. Customers must wait until they receive a ready-for-pickup notification before visiting the pickup location.

Third-party pickup locations, including JNC Skate Sharpening, act only as designated pickup points for Dangle First orders unless otherwise expressly stated. They do not process Dangle First returns, exchanges, refunds, order modifications or customer-service requests.

SECTION 6 - INTELLECTUAL PROPERTY

The Services and their contents, including Dangle First names, logos, original artwork, graphics, photographs, videos, text, product designs, collection names and other original materials, are owned by or licensed to Dangle First Hockey Co. and are protected by applicable Canadian and international intellectual property laws.

The Services are provided for your personal, non-commercial use.

Unless expressly authorized by us, you may not reproduce, distribute, modify, sell, commercially exploit, republish or create derivative works from Dangle First content or artwork.

Dangle First names, logos, designs and other brand identifiers may not be used in a manner that suggests sponsorship, endorsement or affiliation without our permission.

Third-party names, trademarks and intellectual property appearing through the Services remain the property of their respective owners.

SECTION 7 - OPTIONAL TOOLS

We may provide access to tools, services or functionality supplied by third parties.

Such tools may be provided on an "as is" and "as available" basis. Your use of third-party tools may also be subject to the applicable third party's terms and policies.

We may introduce new features, tools and services from time to time, and those features will also form part of the Services and be subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS AND SERVICES

The Services may contain links to websites or services operated by third parties.

We are not responsible for the content, accuracy, privacy practices, products or services offered by third parties.

You should review the policies and terms of third-party websites before entering into transactions with them.

Questions or disputes concerning products or services provided directly by a third party should be directed to that third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Dangle First Hockey Co. is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Dangle First Hockey Co.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Dangle First Hockey Co., including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from claims, damages and liabilities arising from or related to purchases and transactions with Dangle First Hockey Co., to the extent permitted by applicable law.

SECTION 10 - PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is powered by Shopify, certain personal information is processed by Shopify and other service providers as necessary to operate our store, process transactions, prevent fraud, fulfill orders and provide related services.

SECTION 11 - REVIEWS, FEEDBACK AND SUBMISSIONS

If you submit reviews, photographs, feedback, suggestions or other content to Dangle First, you represent that you have the necessary rights to provide that content.

You grant Dangle First a non-exclusive, worldwide, royalty-free licence to use, reproduce and display voluntarily submitted reviews and feedback for purposes related to operating and promoting our business, subject to applicable law.

You must not submit unlawful, defamatory, abusive, infringing, deceptive or malicious content.

We may remove content that violates these Terms or applicable law.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges or delivery estimates.

We reserve the right to correct errors, update information or cancel affected orders where reasonably necessary.

If an order is cancelled after payment because of an error on our part, the applicable payment will be refunded.

SECTION 13 - PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to violate applicable laws or regulations, infringe intellectual property or privacy rights, transmit malicious software, engage in fraud or deception, interfere with the security or operation of the Services, collect personal information without authorization, or engage in conduct intended to harm Dangle First, Shopify, our customers or other persons.

We may restrict or terminate access to the Services where these Terms are violated.

SECTION 14 - AUTOMATED SYSTEMS AND AGENTS

Automated systems, bots, agents, scraping tools or similar technologies must not access or interact with the Services in a manner that circumvents security controls, access restrictions, CAPTCHAs, robot exclusion measures or other technical safeguards.

We may limit or block automated access where necessary to protect the Services, our customers or our business.

SECTION 15 - TERMINATION

We may suspend or terminate access to the Services where reasonably necessary, including where these Terms have been violated.

Termination does not affect rights or obligations that arose before termination or provisions that by their nature should continue after termination.

SECTION 16 - DISCLAIMER OF WARRANTIES

To the extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

We do not guarantee that access to the Services will always be uninterrupted, secure or error-free.

Nothing in these Terms excludes or limits any warranty, condition, right or remedy that cannot legally be excluded under applicable consumer-protection law.

SECTION 17 - LIMITATION OF LIABILITY

To the extent permitted by applicable law, Dangle First Hockey Co., its directors, officers, employees, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential damages arising from use of the Services.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited under applicable law.

SECTION 18 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Dangle First Hockey Co. and its directors, officers, employees, contractors and service providers from third-party claims arising from your unlawful use of the Services, violation of these Terms, or infringement of another person's rights.

SECTION 19 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.

SECTION 20 - WAIVER AND ENTIRE AGREEMENT

Failure to enforce a provision of these Terms does not constitute a waiver of that provision.

These Terms, together with the policies referenced through our store, constitute the agreement governing your use of the Services and purchases from Dangle First.

SECTION 21 - ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign our rights and obligations in connection with a reorganization, sale, transfer or other lawful change involving our business, subject to applicable law.

SECTION 22 - GOVERNING LAW

These Terms and your use of the Services are governed by the applicable laws of the Province of Manitoba and the federal laws of Canada applicable therein, without limiting any rights you may have under mandatory consumer-protection laws applicable in your jurisdiction.

Subject to applicable law, disputes relating to these Terms or the Services will be resolved in the courts of Manitoba, Canada.

Section headings are provided for convenience and do not affect the interpretation of these Terms.

SECTION 24 - CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our Services, business practices or legal requirements.

The current version will be posted on our website. Where required by applicable law, notice of material changes will be provided.

Continued use of the Services after updated Terms become effective constitutes acceptance of those Terms, subject to applicable law.
